A person commits the offense of "Possession of Alcoholic Beverage in Motor Vehicle" if:

a) They have any open container of alcoholic beverage in the passenger compartment of a motor vehicle while it is being operated on a public roadway.
b) They have an alcoholic beverage in a motor vehicle, regardless of whether it is open or closed, while it is being operated on a public roadway.
c) They are a passenger in a motor vehicle with an open container of alcoholic beverage in the passenger compartment.
d) None of the above.
